DERA ONLINE EMERGENCY OPERATIONS CENTER - Registration Agreement Terms

This is a forum for open discussion and debate among members of the online public and the DERA Leadership Team. All posts made to these forums express the views and opinions of the authors, and do not necessarily represent the policy or position of DERA as an organization.

You agree not to post any abusive, obscene, vulgar, slanderous, hateful, threatening, sexually-oriented language, images or any other material that may violate applicable laws or policies of this site. Doing so may lead to you being immediately and permanently banned and a formal complaint being filed with your service provider and law enforcement agencies.

ATTENTION SPAMMERS AND ADVERTIZERS:

The posting or attempted posting of spam or unapproved* advertizements to this site will result in a $450.00 charge for each instance of the ad or spam which requires moderation or removal by the site administrator. Charges are due and payable within ten days of the posting/attempted posting. Overdue accounts are subject to a $25.00 rebilling fee each 10 day billing cycle, and a 23.5% APR commercial finance charge (.06444% daily rate), compounded from date of first transaction. If the State of Colorado or the U.S. Government should establish a different APR as the maximum allowable commercial finance rate, then the maximum APR allowable by law shall apply from the time said law becomes effective, and no specific amendment to this agreement shall be necessary. DERA will pursue collection on all unpaid invoices to the fullest extent of the law. By clicking the "Agree" statement below, you are entering a legal and binding contract regarding these terms and agree to pay these service charges in full. You also agree that without exception, all disputes over this agreement or resulting charges shall be settled in accordance with Colorado (USA) law, and that all legal claims by either party shall be filed in Larimer County (Fort Collins) Colorado, USA. The prevailing party in court shall be entitled to recover from the offending party all expenses related to legal proceedings, collection, investigation, etc. (*"Unapproved" advertizements include but are not limited to invitations to adult-themed services, internet sites or addresses, money or land schemes, medication or herbal promotions, and commercial announcements unrelated to the discussion topic or otherwise deemed inappopriate by the moderator or webmaster.) SPAM and malicious postings are also subject to additional fees based on the time and expenses needed to remove them and recover the site. Technical fees may range from $150-$400 per hour or more depending the situation. The IP address of all posts is recorded to aid in enforcing these conditions.

DERA members with commercial announcements/invitations and legitimate advertizers are invited to contact the site administrator to arrange appropriate ad placement prior to posting.

You agree that the webmaster, administrator and moderators of this forum have the right to remove, edit, move or close any topic at any time should they see fit. As a user you agree to any information you have entered above being stored in a database. While this information will not be intentionally disclosed to any third party without your consent the webmaster, administrators and moderators cannot be held responsible for any hacking attempt that may lead to the data being compromised.
